Terms & Conditions of tutoring

These Terms & Conditions apply to the weekly online tutoring service provided by Captain Physics (“I”, “me”, “my” or “Captain Physics”).

By booking and paying for the tutoring service, the parent or guardian (“the Parent”) agrees to these Terms & Conditions on behalf of the student where the student is under 18.

Please read these Terms & Conditions carefully before purchasing the service.

1. The tutoring service

Captain Physics tutoring provides online group tutoring and educational support for students.

The service is provided on a weekly basis during the academic year and may include:

* Live online tutoring sessions

* Access to recordings of tutoring sessions

* Lesson resources

* Revision materials

* Additional resources provided as part of the tutoring service

The exact content of the service may vary during the academic year depending on the needs of the students and the planned programme of study.

2. Weekly payment

The tutoring service is paid for by a weekly fee.

The weekly fee is fixed for the academic year and will not change increase during that academic year.

Payment is made through the payment method provided on the website, by direct debit.

Where a recurring payment arrangement is used, the Parent authorises the relevant payment provider to collect the agreed weekly fee.

The weekly fee covers the tutoring service and access to the resources and recordings provided during the period for which the student is enrolled.

3. Academic year and holidays

The tutoring programme will operate according to the published academic timetable.

There may be breaks during school holidays, other periods where no tutoring session takes place.

Where no session is scheduled, there will be no charge for that week. No additional tutoring session will normally be provided unless this has been specifically communicated as part of the programme.

The details of the tutoring schedule will be communicated to parents and students.

4. Missing a tutoring session

Students are expected to attend the live tutoring session whenever possible.

If a student is unable to attend, they may access the recording of the session where a recording is available.

Missing a live session does not entitle the Parent to a refund or reduction in the weekly fee.

Recordings are provided as a convenience and are not guaranteed to be available indefinitely.

Captain Physics tutoring reserves the right to remove recordings after a reasonable period or at the end of the relevant academic year if appropriate

5. Recordings

Where tutoring sessions are recorded, recordings are made available only to students who are enrolled in the relevant tutoring service.

Recordings must not be:

* Shared with other students or individuals

* Uploaded to social media

* Posted on websites or online forums

* Distributed through messaging groups

* Downloaded and redistributed

* Used for commercial purposes

* Edited or reproduced without permission

Recordings are provided for the student's personal educational use only.

Captain Physics tutoring reserves the right to withdraw access to recordings if these Terms & Conditions are breached.

6. Cancellation

Parents may cancel the tutoring service at any time through the cancellation facility provided on the website.

Cancellation will stop future payments in accordance with the cancellation process.

Once a cancellation takes effect, the student will no longer have access to future tutoring sessions, recordings or resources provided as part of the service.

The student may retain access to resources or recordings only for as long as stated by Captain Physics tutoring

Cancellation does not normally provide a refund for tutoring or resources that have already been provided.

Nothing in these Terms & Conditions affects any statutory cancellation rights that the Parent may have under applicable consumer law.

7. Refunds

The tutoring service is provided on a weekly basis.

As a general policy, payments for a week in which the student has received or had access to the tutoring service, resources or recordings are non-refundable, including where the student chooses not to attend a live session.

Where a Parent cancels before a future payment is due, future payments will be stopped and no further weekly fees will normally be charged.

Where a payment has already been taken for a period that has not yet begun, the Parent may be entitled to a refund depending on the circumstances and any applicable statutory cancellation rights.

If Captain Physics tutoring cancels a scheduled service and is unable to provide a reasonable alternative, an appropriate refund or credit may be offered for the affected period.

Nothing in this refund policy affects the Parent's statutory rights under UK consumer law.

8. Consumer cancellation rights

Where the tutoring service is purchased online, consumers may have a statutory right to cancel certain contracts within 14 days of entering into the contract.

If the Parent asks for the tutoring service to begin during this 14-day period, the Parent may be asked to expressly acknowledge this when purchasing the service.

Where the service has already been provided, the amount payable following cancellation may be affected by the amount of the service that has already been supplied, subject to applicable consumer law.

Where the service has been fully performed during the cancellation period following the customer's express request and acknowledgement, statutory cancellation rights may no longer apply.

These Terms & Conditions do not seek to remove or restrict any consumer rights that cannot legally be excluded.

9. Educational resources and copyright

All educational materials provided by Captain Physics tutoring remain the intellectual property of Captain Physics tutoring or the relevant copyright owner.

This includes, but is not limited to:

* Workbooks, lesson notes, practice questions, diagrams, presentations, videos, recordings

* Other materials created or supplied as part of the tutoring service

These materials are provided for the personal educational use of the enrolled student.

Unless permission has been given in writing, materials must not be:

* Shared with other students

* Uploaded to websites or social media

* Distributed electronically

* Sold or commercially reproduced

* Photocopied or reproduced for distribution to others

* Used by another tutor or educational provider

* Incorporated into another commercial educational product

A Parent may make a reasonable copy of a resource for the enrolled student's own personal educational use where necessary, but copies must not be distributed to other people.

If you are unsure whether a particular use is permitted, please ask before reproducing or sharing the material.

10. Use of resources after cancellation

Once the tutoring service has been cancelled, the student may continue to use resources that they have legitimately received for their own personal educational purposes, unless otherwise stated.

However, the student and Parent must continue to respect the copyright and intellectual property rights described in these Terms & Conditions.

Access to online resources, recordings and other subscription-based materials may end when the tutoring service is cancelled.

11. Student behaviour

Students are expected to behave respectfully towards the tutor and other students.

Students must not:

* Disrupt lessons deliberately

* Harass, bully or intimidate other students

* Use inappropriate or offensive language towards others

* Deliberately interfere with the online lesson

* Share inappropriate material during a lesson

* Attempt to gain unauthorised access to another student's information or account

If a student's behaviour seriously or repeatedly disrupts the service, Captain Physics tutoring may take appropriate action, including asking the student to leave a session or, in serious circumstances, ending the student's participation in the tutoring service.

Where appropriate, the Parent will be informed.

12. Online lesson environment

Parents and students are responsible for ensuring that they have:

* A suitable internet connection

* An appropriate device

* Access to the required online platform

* A suitable environment in which to participate in the lesson

Captain Physics tutoring is not responsible for technical problems caused by the student's device, internet connection or home environment.

If a technical problem affects the service provided by Captain Physics tutoring, reasonable steps will be taken to resolve the problem or provide an appropriate alternative where possible.

13. Tutor cancellation or unavoidable disruption

Although every effort will be made to provide sessions as scheduled, occasionally a session may need to be cancelled or rescheduled due to circumstances such as illness, technical problems or other events outside reasonable control.

Where reasonably possible, parents will be informed in advance.

Where a session cannot be provided, Captain Physics tutoring will aim to provide a reasonable alternative, such as:

* A replacement session

* A recording or alternative educational material

* A credit or refund where appropriate

The appropriate solution will depend on the circumstances.

14. Academic results

Captain Physics aims to provide high-quality educational support but cannot guarantee any particular examination result, grade or academic outcome.

A student's progress and results depend on a number of factors, including attendance, engagement, independent study and preparation.

15. Communication with parents

Parents may be contacted using the contact details provided when registering for the service.

This may include information about:

* Lessons

* Schedule changes

* Resources

* Recordings

* Payments

* Cancellations

* Other matters relating to the tutoring service

Parents are responsible for ensuring that their contact details remain accurate.

16. Suspension or termination of the service

Captain Physics may suspend or terminate access to the tutoring service in circumstances including:

* Serious or repeated breaches of these Terms & Conditions

* Abusive or inappropriate behaviour

* Non-payment of fees

* Unauthorised sharing or distribution of copyrighted materials or recordings

* Deliberate misuse of the online service

Where reasonably possible, the Parent will be informed before access is terminated.

Any statutory consumer rights remain unaffected.

17. Changes to the service

Captain Physics may make reasonable changes to the tutoring programme, timetable, resources or method of delivery where necessary.

For example, changes may be required because of the academic curriculum, examination timetable, technology or other circumstances.

Where a significant change is proposed, parents will be informed where appropriate.

The weekly fee will remain fixed for the academic year unless a change is agreed with the Parent or is otherwise permitted by law.

18. Privacy and personal information

Personal information provided as part of the tutoring service will be handled in accordance with the Captain Physics tutoring Privacy & GDPR Policy.

The Privacy & GDPR Policy explains what personal information is collected, why it is used, how it is protected and the rights of individuals.

19. Limitation of liability

Captain Physics will take reasonable care in providing the tutoring service and educational materials.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Subject to this, Captain Physics will not be responsible for losses that could not reasonably have been anticipated or for problems caused by circumstances outside reasonable control.

Nothing in these Terms & Conditions affects a consumer's statutory rights.

20. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be dealt with in accordance with applicable UK law and the appropriate courts.
